THE CONTRACT
These Booking Conditions contain important information and form a legally binding contract between you and Travel Ogg Pty Ltd, trading as Dark Sky Traveller.
By booking with TO and paying a deposit or full payment, you acknowledge that you have read, understood, and agree to be bound by these Booking Conditions. Acceptance of your booking will be confirmed in writing by TO, at which time a contract comes into existence.
If you do not understand any part of these conditions, you must raise your query before booking.

1. PRICES & VALIDITY
All prices are quoted in Australian Dollars unless otherwise stated and are based on costs, tariffs and exchange rates applicable at the time of publication.
Prices are per person on a twin-share basis. Where you elect to travel as a twin-share and no suitable pairing is available, a single supplement will apply and be charged to the solo traveller.
TO reserves the right to adjust prices due to fluctuations in exchange rates, fuel surcharges, taxes or other operating costs, whether or not full payment has been made.

2. YOUR TRIP & ASSUMPTION OF RISK
TO operates trips in a variety of regions where standards of accommodation, transport, safety, hygiene, medical facilities and infrastructure may differ from those at home.
You are responsible for reviewing current travel advice issued by the Australian Department of Foreign Affairs and Trade (DFAT) and relevant authorities of your country of residence.
By booking, you acknowledge that you accept the inherent risks associated with travel and participation in TO tours. TO and its service providers will take reasonable steps to ensure your safety and wellbeing.
3. EXCLUSION & LIMITATION OF LIABILITY
TO acts as agent for third-party suppliers and is not responsible for their acts or omissions.
To the fullest extent permitted by law, TO excludes liability for any loss, damage, injury, illness, delay, death or expense arising directly or indirectly from participation in a tour, including through negligence.
Nothing in these conditions excludes rights under Australian Consumer Law, including guarantees that cannot be excluded by law.
4. CANCELLATION BY TRAVEL OGG
TO reserves the right to cancel a tour due to:

Insufficient participant numbers

Operational or safety concerns

Force Majeure or government travel advice
In such cases, TO will offer alternative arrangements or a refund of payments made, less any unrecoverable supplier costs.
5. FORCE MAJEURE
Force Majeure includes, but is not limited to, war, terrorism, civil unrest, pandemics, epidemics, government restrictions, industrial disputes, weather events, natural disasters, fire, strikes or supplier failure.
TO will not be liable for delays, changes or cancellations due to Force Majeure. Refunds, if any, are subject to supplier terms and unrecoverable costs.
6. CANCELLATION BY YOU
All cancellations must be made in writing.
Domestic Tours

More than 45 days prior: deposit forfeited

30–44 days prior: 75% forfeited

Within 30 days: 100% non-refundable
International Tours

More than 90 days prior: deposit forfeited

60–89 days prior: 75% forfeited

Within 60 days: 100% non-refundable
No refunds apply for unused services or early departure.
7. PAYMENTS
Deposit

AUD $1,000 per person (unless otherwise stated)

Non-refundable once paid, unless the tour is cancelled by TO

Transferable to another traveller with TO approval
Final Payment

Domestic tours: 45 days prior to departure

International tours: 90 days prior to departure
Failure to pay on time may result in cancellation with applicable fees.
8. BOOKING AMENDMENTS
Changes to bookings are subject to the following fees:

120 days or more prior: $450 per person per change

Within 120 days: cancellation fees apply

No amendments permitted within 10 days of departure
Supplier penalties may apply in addition to TO fees.
9. LATE BOOKINGS
Bookings within 30 days of departure require full payment at the time of booking. If confirmation cannot be secured, all monies paid will be refunded.
10. PROGRAM CHANGES
Itineraries may change due to weather, safety, availability, or operational requirements. Such changes do not entitle compensation.
11. AUTHORITY OF TOUR LEADER
The decision of the TO Tour Leader is final on matters affecting safety and group wellbeing. Failure to comply may result in removal from the tour without refund.
12. COMPLAINTS
Complaints must be raised as soon as practicable during the tour. Written complaints must be received within 30 days of tour completion.
13. FITNESS & PARTICIPATION
A general good level of fitness and mobility is required. TO may assist where possible; however, additional costs arising from limited participation are the responsibility of the traveller.
14. TRAVEL INSURANCE
Comprehensive travel insurance is mandatory. Insurance may be purchased through TO or independently and must cover medical expenses, evacuation, cancellation and personal liability. You may choose to use your credit card, independent travel insurance or purchase it through Travel Ogg Pty Ltd.
15. PASSPORTS & VISAS
You are responsible for ensuring all travel documentation is valid and compliant.
16. PUBLICITY
You consent to the use of images taken during the tour for promotional purposes without compensation.
17. HEALTH & COVID-19
Participants must not travel while unwell. TO may require compliance with health protocols. Guests testing positive during a tour must isolate at their own expense.
18. GOVERNING LAW
This contract is governed by the laws of New South Wales, Australia.
